Terms of Service

These Terms of Service are between you and Shut Up N Reel LLC, doing business as Fish or Nah ("the Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service

Fish or Nah provides streamflow data, weather conditions, fishability ratings, and optional AI-generated fishing recommendations for fly and conventional fishing on listed USGS stream and river gauges in Pennsylvania, Ohio, New York, West Virginia, and Michigan. In the dashboard you switch between fly and conventional with the FLY / CONV toggle; that setting is saved to your account. Data is sourced from USGS, NWS, and other public agencies and is provided for informational purposes only. Some listed waters are tributaries to the Great Lakes. The Service does not currently cover lake-surface fishing as its own water type.

Accounts

• You must provide a valid email address and keep your login credentials secure.
• You are responsible for all activity under your account.
• One account per person. Sharing accounts is not permitted.
• You must be at least 13 years old to use the Service.

Subscriptions and Billing

• Free plan — listed streams in PA, OH, NY, WV, and MI; USGS flow; trend charts; NWS weather; wading sketchiness; stream pinning; and the fly / conventional toggle. No payment required.
• Pro plan — $49 USD/year or $9 USD/month, billed through Stripe on the interval you choose at checkout. Includes everything in Free plus AI stream forecasts (including a 5–6 day flow outlook), AI fly or lure/bait picks, and condition-specific tips. Pro AI requests are limited to 20 per hour.
• Checkout uses the live Stripe Price configured for Pro. Your subscription renews automatically at the end of each billing period, monthly or yearly as you chose, unless you cancel.
• You may cancel at any time through Manage Subscription, which opens the Stripe customer portal. Canceling stops future renewals. Your Pro access remains active through the end of the current billing period while the Stripe subscription remains active or trialing.

Cancellation versus account deletion

Canceling Pro keeps your Fish or Nah account and Free access after the paid period ends. Deleting your account removes the account from Fish or Nah. If a Stripe subscription is attached, deletion cancels billable Stripe subscriptions first so you are not billed again, then deletes the account. Stripe may still retain its own billing records. Email bro@fishornah.com to request deletion, or use Delete account on the plan page while signed in.

Refunds

Subscription fees are non-refundable except where required by applicable law. If you believe you were charged in error, contact us within 14 days and we will review your request. That 14-day support-review window does not restrict rights you may have under applicable law.

Accuracy of Data

Streamflow, weather, fishability ratings, and AI-generated recommendations are provided as-is for informational purposes. Source data may be delayed, cached (stale), incomplete, or unavailable. AI output can be inaccurate. Fishing ratings do not guarantee catches. Recommendations do not establish that it is safe to wade, that access is lawful, or that you have permission to fish. Check current regulations, closures, access permissions, and the water in front of you. Do not rely solely on this Service to assess wading safety or water conditions.

Acceptable Use

You agree not to:

• Scrape, crawl, or bulk-download data from the Service.
• Attempt to reverse-engineer, hack, or disrupt the Service.
• Use the Service for any unlawful purpose.
• Resell or redistribute content from the Service without permission.

Intellectual Property

The Fish or Nah name, logo, and original content (excluding public-domain data from USGS and NWS) are owned by Shut Up N Reel LLC. You may not use them without written permission.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose or uninterrupted availability. Nothing in these Terms excludes rights or liabilities that cannot legally be excluded.

Limitation of Liability

To the fullest extent permitted by law, Shut Up N Reel LLC (d/b/a Fish or Nah) shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to personal injury, property damage, or lost profits. Our total liability for any claim shall not exceed the amount you paid us in the 3 months preceding the claim. These limits do not apply where applicable law does not allow them.

Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account as described above. Upon termination, your right to use the Service ends immediately, except that canceled Pro access continues only through the already-paid billing period as described under Subscriptions and Billing.

Changes to These Terms

We may update these Terms. Material changes will be communicated by email or site notice at least 14 days before taking effect. Continued use after the effective date constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles.
