Terms of Service

These Terms of Service are between you and Shut Up N Reel LLC, doing business as Fish or Nah ("the Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service

Fish or Nah provides real-time streamflow data, weather conditions, and AI-generated fishing recommendations for fly anglers in Pennsylvania, Ohio, New York, and West Virginia. Data is sourced from USGS, NWS, and other public agencies and is provided for informational purposes only.

Accounts

• You must provide a valid email address and keep your login credentials secure.
• You are responsible for all activity under your account.
• One account per person. Sharing accounts is not permitted.
• You must be at least 13 years old to use the Service.

Subscriptions and Billing

• Free plan — access to streamflow data, flow charts, weather, and wading conditions. No payment required.
• Pro plan — $20/month, billed monthly. Includes everything in Free plus AI stream forecasts, fly picks, hatch tips, and personalized conditions analysis.
• Billing is handled by Stripe. Your subscription renews automatically each month unless canceled.
• You may cancel at any time through your account portal. Your Pro access remains active through the end of the current billing period.

Refunds

Subscription fees are non-refundable except where required by applicable law. If you believe you were charged in error, contact us within 14 days and we will review your request.

Accuracy of Data

Streamflow, weather, and AI-generated recommendations are provided as-is for informational purposes. Fishing conditions change rapidly and data may be delayed, inaccurate, or incomplete. Do not rely solely on this Service to assess wading safety or water conditions. Always use your own judgment and follow local regulations. Fish or Nah is not responsible for decisions made based on information provided by the Service.

Acceptable Use

You agree not to:

• Scrape, crawl, or bulk-download data from the Service.
• Attempt to reverse-engineer, hack, or disrupt the Service.
• Use the Service for any unlawful purpose.
• Resell or redistribute content from the Service without permission.

Intellectual Property

The Fish or Nah name, logo, and original content (excluding public-domain data from USGS and NWS) are owned by Shut Up N Reel LLC. You may not use them without written permission.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose or uninterrupted availability.

Limitation of Liability

To the fullest extent permitted by law, Shut Up N Reel LLC (d/b/a Fish or Nah) shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to personal injury, property damage, or lost profits. Our total liability for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ends immediately.

Changes to These Terms

We may update these Terms. Material changes will be communicated by email or site notice at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.

Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles.
